How Our At-Fault Accident Lawyers Help in Fort Worth
We prove who caused your crash and push back when the insurer tries to shift blame onto you. Fault arguments are where most car accident claims are won or lost.
When you hire us, we:
- Get the crash report and check it for errors
- Find camera video, phone records, and witnesses
- Identify every party who may share fault
- Answer the insurer’s blame arguments with evidence
- Take the case to court if the insurer won’t be fair
How Fault Is Determined in a Texas Car Accident
Fault depends on who failed to drive with reasonable care. Insurers and juries look at:
- Traffic laws that were broken, such as speeding or failing to yield
- The officer’s findings and any citations
- Video, photos, and the damage to each vehicle
- Witness statements
- Phone use, alcohol, or drug test results
Some crash types point to a likely answer. In a rear-end crash, the following driver is usually at fault. In a left turn crash, the turning driver often is. Neither is automatic.
Texas Modified Comparative Fault (the 51% Rule)
Texas lets you recover even if you share some blame, but only up to a point. Under Chapter 33 of the Civil Practice and Remedies Code, a jury assigns each party a percentage of fault.
- At 50% or less, your damages are reduced by your share.
- At 51% or more, you recover nothing.
This is why insurers often argue you were partly to blame, for example that you were speeding slightly or braked suddenly. Even a small shift in percentages changes what they pay. Learn more about contributory fault.
Who Else Can Be Liable for a Car Accident?
Fault is not always limited to the other driver. Other parties can be responsible:
- Employers, when their driver was working at the time
- Vehicle or parts makers, when a defect caused or worsened the crash
- Bars or restaurants, in some cases where they over-served a drunk driver
- Government agencies, for dangerous road conditions, subject to strict notice rules under the Texas Tort Claims Act
Finding every responsible party can matter when one driver’s insurance is too small to cover your losses.

Who Is At Fault For My Fort Worth Car Accident? FAQs
Does the police report decide who is at fault in Texas?
No. The officer's opinion in the crash report carries weight with insurers, but it is not the final word. Insurers, judges, and juries look at all the evidence, including video, witness statements, and vehicle damage. A report that blames you can be challenged with better evidence.
Can I get compensation if I was partly at fault for a car accident?
Yes, if your share of fault is 50% or less. Texas modified comparative fault reduces your recovery by your percentage. For example, if you were 20% at fault, your damages are reduced by 20%. If you are more than 50% responsible, you cannot recover from the others.
What if both drivers blame each other?
Then the evidence decides. Traffic camera video, dashcams, phone records, witness accounts, and the damage pattern on each vehicle often show what happened. A lawyer can obtain this evidence quickly and, in serious cases, use an accident reconstruction professional.
